Dois-je demander une autorisation pour piscines en plastique en jardins de lotissements ?

Have you opted for an apartment rental with a garden or found a house to rent? In this new outdoor space, you may be thinking of installing a swimming pool for your children. But do you need a permit for plastic swimming pools in a housing estate garden? Response elements.

What authorisation do you need for a plastic swimming pool in a housing estate garden?

The construction and installation of swimming pools are subject to very specific rules, in particular for non-collapsible swimming pools. When renting an apartment with a garden, a swimming pool with a fixed base, whatever the volume, is subject to a public inquiry, unless it is an above-ground swimming pool with a capacity less than 15 m3. The survey will also be mandatory for an inflatable rental pool if its capacity exceeds 15 m3. On the other hand, municipal authorisation is sufficient for an inflatable swimming pool in a rental provided that the pool is removable, above ground, and with a volume between 5 m3 and 15 m3. Finally, for an inflatable pool in a rental with these same characteristics, except for volumes greater than 5 m3, it is not necessary to take any action. Clearly, no authorisation for a plastic swimming pool in a housing estate garden is formally required providing it is removable, above ground, and with a volume no greater than 5 m3.

Apartment rental with garden or house: what precautions need to be considered for an inflatable swimming pool in a rental property?

In addition to the authorisation required for plastic swimming pools in a housing estate garden (vis-à-vis the municipality or the canton), it is necessary to inquire about safety requirements for children on the estate. Because even in a small inflatable pool, in a rental on a housing estate, children are at risk of drowning. If your neighbours' child falls through a hole in your fence and jumps into the pool, or bumps into it and drowns, you could very well be considered liable. Also, when renting an apartment with a garden, this type of risk must be taken into account. Several solutions make it possible to minimise these risks. You can remove the ladder after use, install a solid cover with a padlock, or even build a fence with a lock to prevent a child from gaining access.

Inflatable swimming pools in rentals: what inconveniences may arise vis-à-vis the neighbours?

When renting an apartment with a garden, you must still respect the tranquillity of your neighbours. Even a small inflatable pool in a rental can cause a nuisance. It is therefore necessary to ensure that children do not make too much noise, especially after certain times, and that no one can see people changing around the pool. Also, when emptying water from the swimming pool, be careful  not to discharge chlorinated water onto the neighbouring property. And if, at the end of the day, you decide you would prefer to invest in a house to rent outside of a housing estate,  instead of renting an apartment with a garden, you’ll find what you’re looking for on SherlockHomes.
